With the release of horrifying security video showing a man allegedly attacking his wife while their daughter tries to defend her mother, the brutal reality of gender-based violence has once again been brought into stark relief. On behalf of the mother and child, AfriForum’s Private Prosecution Unit is prosecuting the case. On a number of assault-related offences, the accused man appeared yesterday in the Bellville Magistrate’s Court in Cape Town.
Because a kid is at the center of the investigation, the identity of the parties are being kept confidential. The video surveillance will be used as part of the prosecution’s case against the accused, a prosperous businessman with roots in Cape Town.
In pictures that are reminiscent of the Jaco Swart assault case, which sparked widespread indignation and condemnation, a guy can be seen strangling a lady on a bed after dominating her and hitting her repeatedly, especially in the face. A young girl tries to stop the assault as he is doing this.
The couple’s closed-circuit TV recorded several instances. The client of the unit filed a charge of abuse against her husband in August 2018. The suspect was detained by the police and eventually released on bail. Unfortunately, the mom and her kid had suffered through years of physical and psychological abuse. The case was ultimately dropped after her former attorney informed the prosecutor that the witness was psychologically unfit to testify.
AfriForum’s Private Prosecution Unit met with the woman who is now prepared to move through with the case after the Jaco Swart video’s release last year. The case was re-enrolled after the unit’s arguments with the National Prosecuting Authority (NPA) were heard.
The unit’s spokesperson, Barry Bateman, praised the NPA for bringing the case back to the roster. “In order to guarantee that justice is served, we will closely monitor this case. We encourage those who have experienced gender-based violence to speak up and get help. There will always be someone at your side, just like our unit has done for countless other women in comparable situations, adds Bateman.
The matter was postponed to 16 February 2023.
